How patent translations work

Registering an international patent requires scrupulous attention: first of all, the intellectual property documents need to be translated into all the local languages of the States where the patent is to be filed.

Then, the text of the patent itself needs to be faithfully reproduced in the target language, paying particular attention to terminological accuracy and clarity of presentation.

What changes has the European unitary patent introduced?

The European patent with unitary effect, which came into force in June 2023, is a patent granted in accordance with the procedures of the European Patent Convention (EPC) to provide uniform protection in EU Member States.

For patents filed in French or German – which, with English, form the three official languages of the European Patent Office (EPO) – a full translation into English must be provided (of the text, drawings and claims) during the transition period of six years (which may be extended to up to seven years from the entry into force of the unitary patent); for patents filed in English, a full translation must be provided into just one of the other official languages of the EU, including Italian or any other language of the EU countries that have joined the unitary patent system.

At the end of the transition period, for a unitary patent published in English, French or German whose claims have been translated into the other two languages, no further translations will be necessary.
