{"id":11172,"date":"2024-01-29T08:28:11","date_gmt":"2024-01-29T07:28:11","guid":{"rendered":"https:\/\/www.aglatech14.com\/the-european-unitary-patent-how-has-it-changed-the-way-intellectual-property-firms-work-in-italy\/"},"modified":"2026-09-16T17:35:42","modified_gmt":"2026-09-16T15:35:42","slug":"the-european-unitary-patent-how-has-it-changed-the-way-intellectual-property-firms-work-in-italy","status":"publish","type":"post","link":"https:\/\/www.aglatech14.com\/en\/the-european-unitary-patent-how-has-it-changed-the-way-intellectual-property-firms-work-in-italy\/","title":{"rendered":"The European unitary patent: how has it changed the way intellectual property firms work in Italy?"},"content":{"rendered":"<p>The <strong>European patent with unitary effect<\/strong>, which came into force in June 2023, is a patent granted in accordance with the procedures of the European Patent Convention (EPC) to provide uniform protection in 17 European Union member states.<\/p>\n<p>Compared to a classical patent, nothing much has changed in the search and examination carried out\u00a0<strong>by the European Patent Office<\/strong>\u00a0<strong>(EPO)<\/strong> before granting a patent. The real difference lies in the possibility of validating the patent\u00a0<strong>in 17 EU countries with just one application to the EPO<\/strong>\u00a0and by paying a single annuity fee for all 17 countries. This results in significant time and cost savings.<\/p>\n<p>The <strong>Unified Patent Court<\/strong> (UPC) is the new international court with jurisdiction over unitary patents and European patents for which an\u00a0<strong>opt-out<\/strong> \u2014 a request to leave the jurisdiction of the unitary court and return exclusively under the jurisdiction of national courts \u2014 has not been requested.<\/p>\n<p>Within six months of the <strong>European unitary patent<\/strong> coming into force, the EPO had registered:<\/p>\n<ul>\n<li>15,845 patent applications with unitary coverage;<\/li>\n<li>15,496 patent registrations of the same type.<\/li>\n<\/ul>\n<p>(Source: Patent Index dashboard\u00a0<a href=\"https:\/\/new.epo.org\/en\/statistics-centre%23#\/unitary-patent\">https:\/\/new.epo.org\/en\/statistics-centre#\/unitary-patent<\/a>).<\/p>\n<p>But what are the effects of the European unitary patent on the way specialists, i.e. intellectual property consultancies, work? We asked <strong><em>Alessandra Bosia<\/em><\/strong>, European and Italian Patent and Design Attorney Partner at <em>Studio Torta<\/em>.<\/p>\n<p><em>Studio Torta<\/em>\u00a0specialises in intellectual property consultancy for the granting of patents, trademarks, designs and plant varieties in Italy and abroad. Its team of two hundred people, specialised in all areas of technology, applied sciences and intellectual property law, advises and assists clients in obtaining intellectual property rights and in defending them worldwide through a consolidated and extensive network of collaborators.<\/p>\n<p><em>Aglatech14:<\/em><\/p>\n<p><strong>How has your work changed since the unitary patent came into force? How has it affected the operations, organisation and volumes of an intellectual property firm like yours?<\/strong><\/p>\n<p><em>Alessandra Bosia:<\/em><\/p>\n<p>The entry into force of the unitary patent hasn&#8217;t really changed the way we work at all. We already had a well-established department in charge of obtaining national validations after the granting of European patents, so all we had to do was implement a new procedure for filing patents with unitary effect.<\/p>\n<p>It&#8217;s true that the entry into force of the unitary patent, alongside other factors, has decreased the number of European patent validations in Italy. However, the new unitary patent applications have rebalanced our workloads, which have remained essentially stable.<\/p>\n<p><em>Aglatech14:<\/em><\/p>\n<p><strong>What type of client opts for the unitary patent and why?<\/strong><\/p>\n<p><em>Alessandra Bosia:<\/em><\/p>\n<p>Clients choosing the unitary patent are typically those companies that previously validated their patents in at least three or four EU countries (among those that have joined the unitary patent system). It&#8217;s worth noting that the annuity fee of a unitary patent is equal to the sum of the annuities for this number of countries. So these companies save money by going down the unitary patent route, while enjoying even broader territorial coverage.<\/p>\n<p><em>Aglatech14:<\/em><\/p>\n<p><strong>What are the reasons for opting out, and what advantages does this bring?<\/strong><\/p>\n<p><em>Alessandra Bosia:<\/em><\/p>\n<p>In addition to patent maintenance costs, there are other elements to consider when choosing a unitary patent. These concern, for example, the fact that unitary patents necessarily fall under the jurisdiction of the Unified Patent Court. If the patent is important and is at risk of being subject to invalidity proceedings, it&#8217;s better to go through the national channels so that it can&#8217;t be invalidated in all countries at once. Besides, the costs of invalidity proceedings at the Unified Patent Court are extremely high. Therefore, if the client wishes to avoid the risk of being drawn into a very expensive lawsuit, the national route is once again recommended.<\/p>\n<p><em>Aglatech14:<\/em><\/p>\n<p><strong>The entry into force of the unitary patent created new roles to be filled within intellectual property firms. How did you handle this?<\/strong><\/p>\n<p><em>Alessandra Bosia:<\/em><\/p>\n<p>The establishment of the Unified Patent Court, more than the entry into force of the unitary patent, has meant that our professionals have had to attend training courses on new court procedures. Our professionals are all qualified to represent clients before the court. We&#8217;ve set up teams of professionals who can collaborate in handling such lawsuits. This is because the unified court times are very short and it would be unthinkable to take on a lawsuit as a single consultant.<\/p>\n<p><em>Aglatech14:<\/em><\/p>\n<p><strong>What&#8217;s happening to patent applications for countries that haven&#8217;t joined the unitary patent system (Croatia, Spain and Poland)?<\/strong><\/p>\n<p><em>Alessandra Bosia:<\/em><\/p>\n<p>In these countries, the national route continues to apply.<\/p>\n<p><em>Aglatech14:<br \/>\n<\/em><strong>Finally, what do you expect from the decision to open the third seat of the Central Division of the Unified Patent Court in Milan?<\/strong><\/p>\n<p><em>Alessandra Bosia:<\/em><\/p>\n<p>It\u2019s difficult to know what to expect. It seems unlikely that many lawsuits will be handled at this seat.
