Different legal systems

Globalisation requires us to govern relations between subjects from different countries. This means that rules and regulations, legal documents and contracts have to be drafted in different languages and according to different legal systems.

The difference between the traditional continental legal system, or Civil Law, and the Anglo-Saxon model, or Common Law, is a striking example of this. The difference between the two systems is substantial: while in civil law systems, based on Roman law and in use in continental Europe (including Italy), codified statutes predominate, in common law countries, namely England, the United States, Australia and the former British colonies or protectorates, case law is of primary importance.

This leads to a whole host of difficulties in the translation of legal documents, because it also requires a ‘transposition’ from one system to another, which only an experienced legal expert can achieve.
